Aim of the Regulation
The Data Act is an EU regulation aimed at providing access for users to their data and facilitating switching between cloud service providers.
Who does it apply to?
The Data Act applies to a lot of different types of organisations, including the providers and users of any “connected products” and their "related services", public sector bodies and providers of data processing services, including cloud based services.
Key Requirements for providers of 'data processing services'
The aim of the requirements on data processing services is to remove any commercial, technical, and organizational barriers that prevent customers from switching to another provider. The key requirements include:
- Data Porting: Allowing customers to port their data and other digital assets to an alternative provider or back to their own devices or systems.
- Phasing Out Switching Charges: The Act mandates the gradual elimination of data egress fees (charges for moving data out of a cloud environment).
- Ensuring Interoperability: To prevent technical lock-in, providers must take measures to ensure interoperability. This includes using open standards and interfaces, which will allow services and applications to be moved between different cloud platforms with minimal need for redesign. The goal is to enable different cloud ecosystems to work together seamlessly.
- Contractual clauses: Contracts for data processing services must detail the conditions and processes for switching, including timelines and the respective responsibilities of both the provider and the customer in accordance with the Act.. They must also provide a comprehensive description of the data and applications that are portable.
How does it apply to Figma
A number of Figma's services are categorised as data processing services under the Data Act.
How does Figma allow users to port their data?
The functionality on the Figma platform allows users to export Figma files in multiple commonly accepted file formats, including .fig, pdf and png. This functionality is standard and available on all Figma plans. Figma does not charge any additional fees to use this functionality.
